Acceptable Use Policy

1. Purpose and Scope

This Acceptable Use Policy ("AUP") governs the use of the WindowEdge AI platform and all associated services by dealers and their authorized staff ("Customer," "you," or "your"). This includes the Dealer CRM (console.windowedge.ai), AI Voice Agents, AI SMS Agents, Quoting and Measurement tools, and the Homeowner Portal (my.windowedge.ai), collectively referred to as the "Service."

This AUP is incorporated into and forms part of the WindowEdge AI Terms of Service. By using the Service, you agree to comply with this AUP. Capitalized terms not defined here have the meanings given in the Terms of Service.

The Service is available to dealers operating in the United States and Canada.

2. Permitted Use

You may use the Service solely for lawful business purposes related to your window and door dealership, including:

  • Managing homeowner leads, contacts, and customer relationships through the Dealer CRM
  • Using AI voice and SMS agents to respond to inbound homeowner inquiries, qualify leads, and schedule in-home sales appointments
  • Creating, delivering, and managing quotes and product proposals for homeowners
  • Providing homeowners access to project status and communications through the Homeowner Portal
  • Analyzing business performance, call quality, and conversion metrics through the platform's reporting tools
  • Integrating the Service with your existing business systems via the WindowEdge AI API, consistent with the API documentation

3. Prohibited Uses

You may not use the Service, or permit any authorized user or third party to use the Service, in any of the following ways:

3.1 Unlawful Activity

  • For any purpose that violates applicable federal, state, provincial, or local law or regulation, including telecommunications law, consumer protection law, and privacy law
  • To engage in, facilitate, or promote any activity that is fraudulent, deceptive, defamatory, or otherwise tortious
  • To transmit or store content that is unlawful, obscene, threatening, or harassing

3.2 Communications Law Violations

  • To initiate outbound AI voice calls or SMS messages to individuals who have not provided valid, documented consent as required by the Telephone Consumer Protection Act (TCPA), Canada's Anti-Spam Legislation (CASL), or any other applicable telecommunications law
  • To contact any individual who has submitted an opt-out request or who appears on a Do-Not-Call registry, in violation of applicable law
  • To circumvent, disable, or interfere with the platform's built-in opt-out processing mechanisms (including STOP keyword handling for SMS and opt-out detection for voice calls)
  • To re-enroll or re-contact an opted-out individual without a new, lawful basis for contact
  • To send unsolicited commercial messages (spam) of any kind
  • To transmit messages at volumes or frequencies that violate applicable messaging carrier guidelines or regulations

3.3 Consumer Deception

  • To instruct, configure, or attempt to cause any AI voice or SMS agent to falsely claim to be a human being when directly and sincerely asked by a consumer whether they are speaking with a human or an AI
  • To use the Service to engage in deceptive marketing practices, false advertising, or misrepresentation of your business, products, or services
  • To impersonate any person, business, or entity that you do not have authority to represent

3.4 Data Misuse

  • To submit Personal Data of individuals to the Service without a lawful basis for doing so, including submitting contact data without the appropriate consent required for the intended communications
  • To submit Personal Data of individuals under 18 years of age
  • To use data accessed through the Service for any purpose other than operating your window and door dealership business
  • To sell, license, transfer, or otherwise share data obtained through the Service (including homeowner contact information and call recordings) with any third party not authorized under your dealership's own privacy disclosures and applicable law
  • To attempt to access, extract, or use the data of any other WindowEdge AI customer

3.5 Platform Integrity

  • To attempt to gain unauthorized access to any part of the Service, its underlying infrastructure, or any other customer's account or data
  • To probe, scan, or test the vulnerability of the Service or any related systems without WindowEdge AI's prior written authorization
  • To introduce malware, viruses, or any malicious code into the Service
  • To interfere with, disrupt, or degrade the availability or performance of the Service for other customers
  • To use automated tools (bots, scrapers, crawlers) to access the Service in ways not authorized by the API documentation
  • To reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service
  • To use the Service to benchmark or evaluate its capabilities for the purpose of developing a competing product or service
  • To resell, sublicense, or provide access to the Service to any third party not authorized under your subscription agreement

3.6 Account Security

  • To share account credentials with individuals not authorized as users under your subscription
  • To create multiple accounts to circumvent usage limits or access controls
  • To attempt to bypass, disable, or circumvent any authentication or access control mechanism of the Service

4. Customer Responsibilities

4.1 Consent Management

You are solely responsible for obtaining all required consents from homeowners and other contacts before submitting their information to the Service or initiating AI-powered communications on their behalf. This includes complying with all requirements of the TCPA (United States) and CASL (Canada), as applicable to your business operations.

WindowEdge AI provides consent tracking features to help you maintain accurate records, but the obligation to obtain valid consent rests entirely with you.

4.2 Authorized Users

You are responsible for all activity that occurs under your account, including activity by your authorized staff. You must ensure that all authorized users are aware of and comply with this AUP. You must promptly revoke access for any user who leaves your organization or whose access is no longer appropriate.

4.3 Accurate Information

You must provide accurate and complete information when registering for and using the Service, including accurate contact and consent data submitted for homeowner records.

4.4 Compliance with Platform Documentation

You must configure and use the Service in accordance with WindowEdge AI's documentation, onboarding guidance, and any applicable compliance notices provided by WindowEdge AI. Failure to follow documented configuration requirements (for example, required call recording disclosures in two-party consent states) may create legal exposure for your business.

4.5 Call Recording Disclosures

You are responsible for ensuring that appropriate call recording disclosures are configured in your AI voice agent settings consistent with the laws of the states or provinces in which your customers are located. WindowEdge AI provides configurable disclosure prompts to support compliance; you are responsible for enabling and maintaining them correctly.

4.6 Reporting Violations

If you become aware of any use of the Service that violates this AUP -- whether by your own staff or by a third party -- you must report it promptly to security@windowedge.ai.

5. Consequences of Violations

WindowEdge AI reserves the right, at its sole discretion, to take any of the following actions in response to a violation or suspected violation of this AUP:

  • Issue a written warning and require corrective action within a specified timeframe
  • Temporarily suspend access to the Service or specific features
  • Terminate the Agreement and your access to the Service, consistent with Section 13.3 of the Terms of Service
  • Report violations to applicable regulatory authorities or law enforcement where required by law or where WindowEdge AI determines it is appropriate to do so
  • Pursue any other remedies available under the Agreement or applicable law

The severity of the response will be commensurate with the nature, scope, and impact of the violation. WindowEdge AI will use good faith judgment in determining the appropriate course of action and will generally seek to notify Customer prior to taking action except where immediate action is necessary to protect the integrity of the Service, the rights of other customers, or consumers.

Nothing in this Section limits WindowEdge AI's rights under the Terms of Service or applicable law.

6. Modifications

WindowEdge AI may update this AUP from time to time to reflect changes in the Service, applicable law, or industry standards. WindowEdge AI will provide at least 30 days' written notice of material changes. Your continued use of the Service after the effective date of any update constitutes your acceptance of the revised AUP.
